ASSUMPTION OF RISK, WAIVER OF LIABILITY, INDEMNITY, AND RELEASE AGREEMENT
THIS IS A RELEASE OF LEGAL RIGHTS.
PLEASE CAREFULLY READ AND UNDERSTAND THIS RELEASE BEFORE SIGNING.
The undersigned (“I,” “me,” “my,” or “myself”), and if applicable, any minor for which the undersigned is a parent or legal guardian (“Minor Participant”) wishes to engage in services provided by Nemesis Jiu Jitsu, LLC (“Nemesis”), a Washington limited liability company, located at 307 N Amboy Avenue, Yacolt, WA 98675 (“Premises”), and acknowledges and agrees to the terms and conditions of this Assumption of Risk, Waiver of Liability, Indemnity, and Release Agreement (“Release” or “Agreement”) as follows:
Nemesis provides jiu jitsu martial arts services, programs, and facilities for families, groups, and individuals (minors and adults). These activities include, but are not limited to, training sessions, classes, competitions, travel opportunities, social events, and other related activities intended to further the services of Nemesis.
In this Agreement, the terms “Released Parties” or “Nemesis” shall include Nemesis, and its owners, officers, members, managers, instructors, employees, volunteers, agents, legal representatives, successors, and assigns.
In this Agreement, the term “Activities” shall include the use of any property, facilities, equipment, and/or services provided, arranged, organized, conducted, facilitated by, or authorized by Nemesis, including but not limited to, opportunities to engage in Jiu Jitsu martial arts training sessions, Jiu Jitsu classes, workshops, competitions, and tournaments, as well as social and extracurricular activities, travel opportunities, other activities that may not be considered directly related to the martial arts services and programs of Nemesis, whether such Nemesis activities are provided on the Premises, including the surrounding areas, or at any location off of the Premises.
Acknowledgement of Risk. On behalf of myself and any Minor Participant, I acknowledge, understand, and appreciate that engagement in the Activities involves rigorous contact sports training and physical interaction, and carries inherent risks of bruises, strains, sprains, joint injuries, fractures, or more serious injuries, illnesses, accidents, and even death to persons (including myself, any minor under my legal supervision, and others), and damages to property, and that these and other risks are inherent in the Activities made possible by Nemesis and cannot be completely eliminated, regardless of the care taken by Nemesis to prevent such risks.
Safety Guidance and Instruction. I agree to actively engage with, follow, and accept full responsibility for familiarizing myself and any Minor Participant with all safety guidance, instructions, protocols, policies, and procedures related to the Activities. I understand that these safety measures are designed to protect all participants and that failure to adhere to them may result in injury to myself, any Minor Participant, or others. I acknowledge that it is my responsibility to ensure that all safety information provided by Nemesis is fully understood and adhered to, and I agree to seek clarification from Nemesis staff if needed.
Photo and Video Release. I grant Nemesis permission to photograph and video record myself and any Minor Participant during participation in the Activities, as defined in this Agreement, and that such photograph and video recordings shall be incorporated into the “Activities” meaning and definition. I understand that these materials may be used by Nemesis for promotional, educational, or other business purposes across various media platforms without requiring additional consent or compensation.
Voluntary Participation and Non-Refundable Fees. I agree that participation in the Activities is completely voluntary, and I acknowledge that myself and any Minor Participant may withdraw from the Activities at any time. I understand that fees already paid may not be refundable in the event of withdrawal.
Medical Considerations. I affirm and agree that: (i) it is my responsibility to seek the advice of a physician to determine whether myself or any Minor Participant are mentally and physically fit to engage in the Activities; (ii) it is my responsibility to timely notify Nemesis prior to engaging in the Activities if myself or any Minor Participant have a mental or physical condition that may require an accommodation, so that reasonable arrangements can be made by Nemesis, if necessary or possible; (iii) Nemesis has the right to disqualify myself or any Minor Participant at any time from engagement in the Activities if Nemesis determines, in its sole discretion, that myself or any Minor Participant are mentally or physically incapable of safely engaging in the Activities, and/or if engagement in the Activities by myself or any Minor Participant would jeopardize the safety of any third parties; and (iv) Nemesis does not assume any liability regarding the provision of medical care for myself or any Minor Participant.
Authorization of Medical Care and My Responsibility for Medical Expenses. In the event that I require medical care for any reason related to the Activities, I hereby authorize Nemesis to act on my behalf to secure proper medical treatment, and to deal with physicians, ambulance transportation companies, and hospitals to obtain prompt medical attention for me. In addition, if any Minor Participant requires medical care for any reason related to the Activities, and Nemesis is unable to communicate with me during a perceived medical emergency, I hereby authorize Nemesis to secure proper medical treatment, and to deal with physicians, ambulance transportation companies, and hospitals to obtain prompt medical attention for any Minor Participant. I agree to pay and accept full liability for any expenses incurred in connection with any such medical treatment for myself or any Minor Participant, including but not limited to, maintenance of adequate health insurance to cover any medical treatment for myself or any Minor Participant.
Assumption of Risk, Waiver, Indemnification, and Hold Harmless. IN CONSIDERATION OF BEING PERMITTED TO ENGAGE IN THE ACTIVITIES, I KNOWINGLY AND VOLUNTARILY AGREE TO ACCEPT AND FULLY ASSUME ALL OF THE KNOWN AND UNKNOWN RISKS RELATED TO ENGAGEMENT BY MYSELF AND ANY MINOR PARTICIPANT IN THE ACTIVITIES, AND I ACCEPT SOLE RESPONSIBILITY FOR ANY INJURY (INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY, DISABILITY AND DEATH), ILLNESS, DAMAGE, LOSS, CLAIM, LIABILITY, OR EXPENSE, OF ANY KIND, THAT MYSELF OR ANY MINOR PARTICIPANT MAY INCUR OR EXPERIENCE IN CONNECTION WITH ENGAGEMENT IN THE ACTIVITIES (“CLAIMS”).I EXPRESSLY FOREVER INDEMNIFY, HOLD HARMLESS, COVENANT NOT TO SUE, WAIVE, RELEASE, AND DISCHARGE THE RELEASED PARTIES OF AND FROM THE CLAIMS, INCLUDING ALL LIABILITIES, ACTIONS, DAMAGES, COSTS OR EXPENSES OF ANY KIND ARISING OUT OF OR RELATING TO
ENGAGEMENT IN THE ACTIVITIES BY MYSELF OR ANY MINOR PARTICIPANT. I UNDERSTAND AND AGREE THAT THIS AGREEMENT INCLUDES RELEASE FROM ANY CLAIMS BASED ON THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE RELEASED PARTIES BEFORE, DURING, OR AFTER ENGAGEMENT IN THE ACTIVITIES BY MYSELF OR ANY
MINOR PARTICIPANT. I EXPRESSLY INTEND FOR THE TERMS OF THIS RELEASE TO BIND ME, ANY MINOR PARTICIPANT, AND OUR FAMILY, HEIRS, GUARDIANS, LEGAL REPRESENTATIVES, SURVIVORS, SUCCESSORS, AND ASSIGNS. I HEREBY AGREE THAT THIS RELEASE SHALL BE ENFORCED TO THE FULLEST EXTENT UNDER THE LAWS OF THE STATE OF WASHINGTON WITHOUT REGARD TO ANY CONFLICT OF LAWS PRINCIPLES.
BY SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT: I am at least eighteen (18) years of age and fully competent; I have read this Agreement fully understand its contents, which I acknowledge as true and correct, and sign it voluntarily, without any coercion, inducement, or assurance made to me, as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written Agreement, have been made; if any portion of the Agreement is held invalid, it is agreed that the remaining provisions, notwithstanding, continue in full legal force and effect; this is the entire Agreement concerning its subject matter, and it supersedes any prior written and/or oral agreements concerning its subject matter.
I AM THE PARENT OR LEGAL GUARDIAN OF ANY MINOR PARTICIPANT NAMED BELOW. I HAVE THE LEGAL RIGHT TO CONSENT TO AND, BY MY SIGNATURE BELOW, I HEREBY CONSENT TO THE TERMS AND CONDITIONS OF THIS RELEASE ON BEHALF OF THE MINOR PARTICIPANT NAMED BELOW.
